By accessing and using this website in any manner, including, but not limited to browsing this website, downloading content, contributing content or other materials to this website you agree to abide by all applicable laws, acknowledge these terms and conditions, and are confirming that you accept these “Terms and Conditions.”

Salubrity and Soul Yoga, LLC offers the following for purchase: yoga classes (online and in-person), (private one-on-one and group) (“Yoga Classes”), (“Workshops”) and (“Retreats”).

The following terms (“Terms and Conditions”) initiate and agreement between Salubrity and Soul Yoga, LLC and the user (“You”) that governs your use of this website and all of its associated services, content and functionality. This policy applies to the following websites (together, “the Sites”) operated by Salubrity and Soul Yoga, LLC (“Salubrity and Soul Yoga”): salubrityandsoulyoga.com and salubrityandsoulyogacarol.com and any other services that we provide that link to these “Terms and Conditions.”

Your access to and use of this website, and all related websites operated by Salubrity and Soul Yoga, LLC : (salubrityandsoulyoga.com) and (salubrityandsoulyogacarol.com) are subject to the following “Terms and Conditions” and all applicable laws. By accessing and browsing the (“Sites”), you accept, without limitation or qualification the “Terms and Conditions” and acknowledge that any other agreements between you and the “Sites” are superseded and of no force or effect.

The services provided by Salubrity and Soul Yoga, LLC are intended for persons 18 years of age or older. No person under the age of 18 is permitted to use or register for services without the express written consent of a legal parent or guardian.

Intellectual Property Rights

Your use is acknowledgement that you agree that the (“Sites”), and all services, products, content, videos, music, class materials and other materials, text, scripts, photos, sounds and interactive features, etc. in the form of content (“Content”), service marks and logos (“Marks”) contained therein, that are made available on Salubrity and Sou Yoga (“Sites”) or on third party sites, including but not limited to the look and feel of the aforementioned are owned by or licensed to “Salubrity and Soul Yoga”, and are subject to copyright and other intellectual property rights under the law. The content on Salubrity and Soul Yoga (“Sites”) is maintained for informational use and your personal use only and may not be copied, reproduced, broadcasted, distributed, downloaded, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of the respective owner/(s). Salubrity and Soul Yoga reserves all rights not expressly granted in and to the websites (“Sites”) and the content.

You agree not to use, copy, or distribute any “Salubrity and Soul Yoga” content (“Content”) other than what has been expressly permitted herein. You agree not to circumvent, disable or otherwise interfere with any security features of the (“Sites”) or that prevent or restrict the use of the (“Sites”) or copy any content or enforce limitations on the use of the (“Sites”) or the content therein.

All information shared by “Salubrity and Soul Yoga” is the property of Salubrity and Soul Yoga, LLC and/or its third party providers. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the services offered by Salubrity and Soul Yoga or the (“Sites”) provided by you (“You”) to “Salubrity and Soul Yoga” are non-confidential and shall become the property of Salubrity and Soul Yoga. You hereby grant “Salubrity and Soul Yoga” the right to use, copy, modify, publish, redistribute, and create derivative works from such (“Feedback”) in any way and without compensation or any obligation to you or any other third party.

Your use of the (“Sites”) and your access provides express consent to receive notifications, documents, correspondence, records, agreements, notices, announcements, disclosures, reports, and other forms of communication from “Salubrity and Soul Yoga” regarding services, offerings, or products, etc., as permitted by law to the primary email address associated with your account or registration. You acknowledge and consent to receiving said forms of communication electronically via email. “Salubrity and Soul Yoga” is not responsibe for any type of filtering that you or your network provider may apply to such notifications.

Privacy

Salubrity and Soul Yoga makes every effort to protect your privacy. As a result, “Salubrity and Soul Yoga” will not intentionally disclose any personally identifying information about you to third parties, except where “Salubrity and Soul Yoga”, in good faith, believes such disclosure is necessary to comply with the law or enforce these “Terms and Conditions.”

“Salubrity and Soul Yoga” shall use commercially reasonable efforts to restrict unauthorized access to it’s data and files. However, no system exists regardless of whether password protected or not, that can be entirely impenetrable. You acknowledge that it is possible for an unauthorized third party to access, view, modify, copy, or distribute the information that you store as a result of using the “Sites.” You agree that your use of the “Sites” is completely at your own risk.

The services offered by “Salubrity and Soul Yoga” may contain links to third-party sites that are not owned, operated or controlled by “Salubrity and Soul Yoga”. As a result, “Salubrity and Soul Yoga” assumes no responsibility for, and does not endorse or verify the content, privacy policies or practices of any third-party sites or services. “Salubrity and Soul Yoga” makes no warranties or representations about the accuracy, completeness, or timeliness of any content posted on any third-party site regarding the services offered by those “Third-Party Sites”.

Service Interruptions

There may be times when the services offered by “Salubrity and Soul Yoga” or access to the (“Sites”) may be temporarily suspended without notice to you due to the following reasons: discontinuations, modifications, additions, updates, maintenance, repairs, security or other similar security or other similar circumstances (Collectively, “Service Interruptions”.) You acknowledge and agree that in the event of such instances you are not entitled to a refund, rebate or any type of of compensation as a result of such “Service Interruptions”.

Modifications and Amendments

Your use of this website establishes you acceptance of, and agreement to the following “Terms and Conditions”. Salubrity and Soul Yoga, LLC reserves the right to modify, alter, amend or update its website, policies and these “Terms and Conditions”. These “Terms and Conditions” are subject to change without notice. If modifications or amendments to these terms become necessary, they will be effective after notifying you of any changes, additions or deletions, as permitted under applicable law. Such notice will be at the sole discretion of Salubrity and Soul Yoga, LLC and may include notification by email, website, newsletter or other manner of communication. If you do not accept or agree with any part of these “Terms and Conditions”, please do not use this website. or purchase from Salubrity and Soul Yoga, LLC.

Disclaimer

As with any physical activity, the risk of injury is possible. Yoga, although considered a wellness based activity, should not be used as a substitute for medically based treatment or diagnosis. You are solely responsible for your own health, wellness and well-being and assume the risk of yoga and any other activity and release Salubrity and Soul Yoga, LLC, and Carol Murphy, from any claims of liability. Your participation in any class, activity, consultation, workshop, or retreat by Salubrity and Soul Yoga, LLC is acknowledgement that your decision to participate is voluntary and your sole responsibility. Salubrity and Soul Yoga, LLC recommends that you consult your physician or preferred health care professional prior to participating in any activity, physical or otherwise, or any exercise program to determine whether it is suitable for you. It is your responsibility to make certain that you do not have a medical condition that you are aware or unaware of that could prevent you from taking part in any class, activity, workshop or retreat. You are solely responsible for participating in any activity at a pace that is suitable for you. You are solely responsible for any risk or injury that you might sustain as a result of your participation. You have read and fully understand this release of liability and fully understand its contents and agree to the terms and conditions stated above.

Errors and Omissions

While “Salubrity and Soul Yoga” makes makes reasonable effort to include up-to-date, accurate information on it’s (“Sites”) “Salubrity and Soul Yoga” makes no warranties or representations as to its accuracy. “Salubrity and Soul Yoga” assumes no liability or responsibility for any errors or omissions with regard to the content on it’s “Sites”.

Salubrity and Soul Yoga, LLC assumes no responsibility for errors or omissions that may appear on the website or in written material for classes, consultations, social media, podcasts, blogs, newsletters, workshops or retreats. All classes, written material, podcasts, blogs, newsletters, workshops and retreats are strictly for educational and informational purposes only. You understand that you are solely responsible for your use of the services offered. You also acknowledge and agree that results may vary with each person / participant / student and Salubrity and Soul Yoga, LLC is not responsible or liable for any expenses that you may incur as a result of your purchase.

Prohibited Uses

You agree not ut use the (“Sites”) and/or (“Services”) for any unlawful purposes or in any way that violates any applicable federal, state, local or international law or regulation. You agree not to engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the services offered, or that may harm “Salubrity and Soul Yoga” or persons using the services of “Salubrity and Soul Yoga” or expose them to a liability, or attempt to interfere with the proper working of the (“Services”) offered on the (“Sites”).

Termination and Survival

Your access to the services provided by “Salubrity and Soul Yoga” may, at any time, be terminated at the sole discretion of “Salubrity and Soul Yoga” without cause or notice. This may be due to, but is not limited to, a breach of the “Terms and Conditions”. In the event that your account or membership is terminated due to a breach of the “Terms and Conditions”, you will not be entitled to receive a refund of any payment, fees or unused portion of any class, class membership, class package, workshop or retreat payments, or any other payments made toward any “Salubrity and Soul Yoga” offerings.

You may not use the (“Sites”) and/or (“Services”) for any unlawful purposes or in any way that violates any applicable federal, state, local or international law or regulation. You may terminate the account or membership that you purchased at any time by providing a cancellation request to: contact@salubrityandsoulyoga.com

You agree to indemnify and hold “Salubrity and Soul Yoga” and its officers, directors, employees and agents harmless from any and all liabilities, claims, damages, and expenses including reasonable attorneys’ fees arising out of or relating to your breach of agreement to these “Terms and Conditions”, any violation by you of law or the rights of any third party, and material information, works and/or other content of whatever nature or media that you post or share on or through the (“Sites”), your use of the (“Sites”) or any services that “Salubrity and Soul Yoga” may offer or provide through the (“Sites”), and your conduct in connection with the (“Sites”) or (“Services”). Salubrity and Soul Yoga reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such an event, you shall provide Salubrity and Soul Yoga with such cooperation as is reasonably requested by “Salubrity and Soul Yoga”.

The provisions of the “Terms and Conditions” are for the benefit of “Salubrity and Soul Yoga” its subsidiaries, affiliates, third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Participant Responsibilities

By accessing this “Site”, you represent that you are at least 18 years of age in your jurisdiction of residence, or are the age of majority in your jurisdiction of residence, and are hereby giving “Salubrity and Soul Yoga” your consent to use the services provided by “Salubrity and Soul Yoga”. If under the age of 18, your parent or legal guardian must consent to the “Terms and Conditions”, complete a waiver that indicates that you are a minor and that they are your parent or guardian agreeing to allow you to use the services provided by “Salubrity and Soul Yoga” prior to utilizing any service offered by “Salubrity and Soul Yoga.”

When accessing services provided by “Salubrity and Soul Yoga”, you may be asked to provide certain details and/or information. You may be required to provide personal information including, but not limited to, your full name, email address, phone number, payment/bank information, or create an account name and/or password. As a condition of your ability to use the services and (“Sites”) of “Salubrity and Soul Yoga” any and all of the information that you provide to “Salubrity and Soul Yoga” must be current, complete and correct. You agree that it is your responsibility to provide accurate information. Not doing so may result in your inability to access the (“Sites”) and/or services.

You agree to not use the account of another, or share your account or account information. Your use of this “Site” is acknowledgement that you are solely responsible for the activity that offers on your account and for maintaining the security and confidentiality of any account that you create on any “Salubrity and Soul Yoga” “Site”. You agree to notify us of any breach of security or unauthorized use of your account as soon as possible.

Injuries, Medical Conditions and Sensitivities

“Salubrity and Soul Yoga” requests that you please notify the yoga teacher/ yoga instructor prior to each class start time if you have a medical condition, are / or may be pregnant, are recovering from an injury or illness, or have any known physical or sensory sensitivities or conditions.

Recordings and Transmissions

You acknowledge and agree that any recordings and/or transmissions via any “Salubrity and Soul Yoga” platform or website are strictly prohibited. (“You”) must obtain prior consent for any type of recording or transmission of any in-person, online or virtual class provided by “Salubrity and Soul Yoga” and each participant who will be identified and affected by your recording and /or transmission. This includes, but is not limited to video recordings, audio recordings, still photography, streaming and social media postings, Zoom, etc. Violations of this agreement to not record or transmit constitutes grounds for exclusion from further participation in any Salubrity and Soul Yoga classes or activities. In addition, your use and access of this site is your acknowledgement and agreement to indemnify, defend and hold harmless “Salubrity and Soul Yoga” and any of its agents, officers, directors, and employees from and against any claims, lawsuits or other actions and all resulting loss, damages, costs or fees of any kind (including attorneys’ fees), resulting from your violation of this non-recording and transmission agreement.

Assignments and Transfers

You may not assign or transfer this agreement, or any of your rights or obligations under this agreement, without prior written consent.

Personal Belongings

You acknowledge and agree that “Salubrity and Soul Yoga” is not responsible for the safekeeping of any of your personal belonging while in attendance of any in-person class session or activity. You assume all risk of loss for any and all of your personal belongings.

Purchasing Policies

You acknowledge that “Salubrity and Soul Yoga” charges fees for its services, and subject to applicable law, “Salubrity and Soul Yoga” reserves the right to change its fees from time to time at its discretion.

All payment transactions for services are required to be made in USD.
